By accessing our website, creating an account or placing an order, you agree to be bound by these Terms of Service together with any other policies referred to on our website, including our Privacy Policy, Returns & Refund Policy, Warranty Policy and Delivery Policy.

If you do not agree with these terms, please do not use our website or purchase products from us.

2. Eligibility & Website Use

By using our website or placing an order, you confirm that:

  • You are at least 18 years old or otherwise legally capable of entering into a binding contract.

  • The information you provide to us is accurate and complete.

  • You are authorised to use the payment method provided.

  • You will use our website only for lawful purposes.

  • You will not interfere with or attempt to compromise the operation or security of our website.

You must not:

  • Introduce viruses, malware or other harmful code.

  • Attempt unauthorised access to our website, servers or systems.

  • Use false identities or deliberately misleading information.

  • Use our website for fraudulent, unlawful or abusive purposes.

  • Attempt to interfere with the normal operation of our services.

We may restrict or suspend access where we reasonably believe our website or services are being misused.

3. Products

We sell products including mobile phones, electronic devices, accessories and other related goods.

Products may include:

  • Brand-new products

  • Pre-owned products

  • Refurbished products

  • Graded products

  • Accessories and related electronic products

The applicable product condition will be stated on the relevant product page wherever appropriate.

We make reasonable efforts to ensure that descriptions, specifications, condition information, photographs and other product information are accurate.

However, minor differences may occur due to:

  • Manufacturer changes

  • Product revisions

  • Screen or display settings

  • Refurbished or pre-owned product condition

  • Packaging variations

For pre-owned, refurbished or graded products, reasonable cosmetic signs of previous use may be present where consistent with the condition or grade advertised.

Nothing in these Terms affects your rights where goods are not as described, are not of satisfactory quality or are not fit for their intended purpose.

4. Product Images & Descriptions

Product photographs are provided to help illustrate the products available.

Unless a listing specifically states that photographs show the exact individual device being purchased, images may be representative.

Colours may appear slightly different depending on:

  • Screen settings

  • Lighting

  • Photography

  • Manufacturer variations

For refurbished or pre-owned devices, cosmetic condition may differ slightly between individual units within the same advertised grade.

Material product specifications and condition information will be described on the relevant product page.

5. Prices & VAT

All prices are displayed in British Pounds Sterling (GBP £) unless otherwise stated.

Prices will include applicable VAT where required.

Some qualifying pre-owned or second-hand products may be sold under an applicable VAT Margin Scheme. Where this applies, VAT may not be separately recoverable by business customers.

We reserve the right to change product prices before an order is placed.

Price changes will not normally affect an order that has already been accepted by us, except where there has been an obvious pricing error or another lawful reason requiring correction.

6. Pricing Errors

We take reasonable care to ensure that prices displayed on our website are accurate.

However, errors may occasionally occur.

If we discover an obvious pricing error after you place an order, we may contact you and:

  • Give you the option to proceed at the correct price; or

  • Cancel the affected item or order and refund any payment already received.

We are not required to supply a product at an obviously incorrect price where the pricing error should reasonably have been apparent.

7. Placing an Order

When you place an order, you are making an offer to purchase the selected products from us.

After submitting an order, you may receive an automated acknowledgement confirming that we have received it.

An automated order acknowledgement does not necessarily mean that your order has been accepted.

We may perform checks relating to:

  • Payment authorisation

  • Stock availability

  • Delivery information

  • Fraud prevention

  • Product availability

  • Order accuracy

A binding contract will normally be formed when we accept your order and confirm acceptance or dispatch, depending on our checkout and order process.

8. Right to Refuse or Cancel an Order

We may refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable.

  • Payment cannot be authorised.

  • An obvious pricing or listing error has occurred.

  • We reasonably suspect fraud or unauthorised payment.

  • Delivery information is incomplete or invalid.

  • The order breaches applicable law or our website policies.

  • An unexpected stock discrepancy prevents fulfilment.

  • Quantity restrictions apply.

If we cancel an order after receiving payment, we will issue an appropriate refund for the cancelled item or order.

9. Payment

Payment must be made using one of the payment methods available during checkout.

Depending on availability, payment methods may include:

  • Visa

  • MasterCard

  • American Express

  • Debit cards

  • PayPal

  • Bank transfer

  • Other payment services displayed at checkout

Payment must be successfully authorised before an order can be processed.

Additional information regarding payments, authorisation, invoices and payment security is available in our Billing Terms & Conditions.

10. Fraud Prevention & Verification

Mobile phones and electronic products can be high-value items. We may therefore perform reasonable fraud-prevention and security checks before accepting or dispatching an order.

We may request additional information to verify:

  • Customer identity

  • Billing information

  • Delivery information

  • Payment authorisation

Where we reasonably believe a transaction may be fraudulent or unauthorised, we may delay, reject or cancel the order.

We will handle personal information used for verification in accordance with our Privacy Policy and applicable data-protection requirements.

11. Delivery

Delivery options, estimated delivery periods and applicable delivery charges will normally be displayed during checkout or on our Delivery Policy page.

Please ensure that your delivery address is complete and accurate before submitting your order.

Estimated delivery dates are estimates unless we have expressly agreed a specific delivery date with you.

Delays may occasionally arise because of circumstances such as:

  • Courier disruption

  • Severe weather

  • Transport disruption

  • Public holidays

  • Incorrect delivery information

  • Events outside our reasonable control

We will comply with our legal obligations relating to the delivery of consumer orders.

Where no different delivery period has been agreed, orders will generally be delivered within the period required by applicable consumer law.

12. Responsibility for Goods During Delivery

For consumer orders where we arrange delivery, responsibility for the goods will normally remain with us until the goods are delivered into your physical possession or the possession of a person identified by you to receive them, subject to applicable law.

This means that using a third-party courier does not automatically remove our responsibilities as the retailer.

Different rules may apply where you independently arrange your own carrier where that carrier was not offered by us.

Please contact us promptly if an order arrives damaged or does not arrive as expected.

13. Checking Your Delivery

When you receive your order, we recommend checking the package and product as soon as reasonably possible.

If you believe that:

  • The wrong item has been supplied

  • An item is missing

  • The parcel has been damaged

  • The product has arrived damaged

  • The product appears faulty

please contact us promptly with your order details.

We may request photographs, videos or other reasonable information to help us investigate the issue.

14. Online Cancellation Rights

Where you are purchasing as a consumer online, you may have a legal right to cancel your purchase without giving a reason.

For most qualifying goods, consumers generally have 14 days after receiving the goods to tell us that they wish to cancel, followed by a further period in which to return the goods in accordance with applicable law.

Certain goods or circumstances may be exempt from cancellation rights where permitted by law.

Further information regarding cancellations, return procedures, exclusions and refunds is provided in our Returns & Refund Policy.

15. Handling Products During the Cancellation Period

Where statutory cancellation rights apply, you may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning, similar to what you would reasonably be able to do in a physical shop.

If a product has been handled beyond what is reasonably necessary and its value has been reduced as a result, we may be entitled to make an appropriate deduction from the refund where permitted by law.

For mobile phones and electronic devices, customers should take particular care regarding:

  • Physical damage

  • Scratches or marks

  • Removing protective films unnecessarily

  • Account activation

  • Activation locks

  • SIM cards

  • Memory cards

  • Accessories and packaging

Nothing in this section restricts your statutory rights where a product is faulty or misdescribed.

16. Faulty Products

Products supplied to consumers must meet applicable legal standards, including being:

  • Of satisfactory quality

  • Fit for purpose

  • As described

If a product is faulty, damaged or does not conform to the contract, you may have statutory rights to a remedy.

Depending on the circumstances and when the problem arises, remedies may include:

  • Refund

  • Repair

  • Replacement

  • Price reduction

Our Warranty Policy provides additional information regarding warranty support.

Any commercial warranty we provide is additional to your statutory consumer rights and does not replace or restrict those rights.

17. Returns & Refunds

Returns, cancellations and refunds are governed by our Returns & Refund Policy together with applicable consumer law.

Different rules may apply depending on whether:

  • You simply changed your mind.

  • The product is faulty.

  • The product was damaged when supplied.

  • The wrong product was supplied.

  • The product was misdescribed.

  • You purchased as a consumer or for business purposes.

Nothing in our Returns & Refund Policy or these Terms is intended to remove rights that cannot legally be excluded.

18. Mobile Phones, IMEI & Serial Numbers

Mobile phones and certain electronic products are uniquely identifiable using an IMEI number, serial number or another device identifier.

We may record these identifiers for legitimate purposes including:

  • Order management

  • Warranty administration

  • Return verification

  • Fraud prevention

  • Product identification

A product returned to us must correspond with the product originally supplied.

We may investigate a return where the IMEI, serial number or other identifying information does not match our records.

19. Customer Accounts & Security

Where our website allows customer accounts, you are responsible for maintaining the confidentiality of your account login information.

You should notify us if you reasonably believe your account has been accessed without authorisation.

We may suspend or restrict an account where reasonably necessary to protect:

  • The customer

  • Other users

  • Our website

  • Our payment systems

  • Our business

20. Promotions & Discount Codes

From time to time we may offer:

  • Discount codes

  • Promotional prices

  • Special offers

  • Limited-time deals

Additional terms may apply to individual promotions.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash.

  • Promotional offers may have an expiry date.

  • Certain products may be excluded.

  • Only one promotion may be used per order where specified.

  • Promotions are subject to availability.

We may withdraw or correct a promotion where there has been an obvious error, fraud or misuse.

21. Intellectual Property

Unless otherwise stated, website content belonging to HILLARCH TRADING LIMITED, including our:

  • Text

  • Graphics

  • Website layout

  • Branding

  • Logos

  • Original photographs

  • Product descriptions

  • Written content

is owned by us or used with appropriate permission and may be protected by applicable intellectual-property laws.

Third-party trademarks, manufacturer names and product images remain the property of their respective owners where applicable.

You must not reproduce, republish, distribute, commercially exploit or modify our protected content without appropriate permission.

22. Third-Party Links & Services

Our website may contain links to websites, applications, payment providers or services operated by third parties.

Third-party websites and services are generally governed by their own terms and privacy policies.

We are not responsible for third-party content or services that are outside our reasonable control.

However, nothing in this section limits responsibilities that we are legally required to accept in connection with your purchase from us.

23. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms is intended to exclude or restrict liability for:

  • Death or personal injury caused by negligence where liability cannot legally be excluded

  • Fraud or fraudulent misrepresentation

  • Your statutory rights relating to faulty, misdescribed or otherwise non-conforming goods

  • Any other liability that cannot legally be excluded or restricted

We will not normally be responsible for losses that were not reasonably foreseeable or that were not caused by a breach on our part.

If you are purchasing as a consumer, we are not responsible for business losses because products supplied for personal use are not intended for commercial or business purposes.

Separate rules may apply to customers purchasing wholly or mainly for business purposes.

24. Events Outside Our Reasonable Control

We will not be responsible for delay or failure caused by circumstances genuinely outside our reasonable control.

Such events may include serious:

  • Transport disruption

  • Natural disasters

  • Government restrictions

  • Telecommunications failures

  • Industrial action

  • Major courier disruption

Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.

This provision does not remove any rights or remedies available to consumers under applicable law.

25. Privacy & Data Protection

We collect and process personal information in connection with website use, orders, payments, delivery and customer support.

Information about how we collect, use, store and protect personal information is provided in our Privacy Policy.

26. Changes to Our Website

We may update, modify, suspend or discontinue parts of our website where reasonably necessary.

We may also update:

  • Product ranges

  • Product descriptions

  • Prices

  • Website functionality

  • Delivery options

  • Payment methods

These changes will not unlawfully affect rights relating to an existing accepted order.

27. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in:

  • Applicable law

  • Our services

  • Website functionality

  • Payment systems

  • Delivery arrangements

  • Business practices

The latest version will be made available on our website.

Changes will not retrospectively remove statutory rights or contractual rights that have already arisen.

28. Business Customers

Where products are purchased wholly or mainly for trade, business, craft or professional purposes, some consumer protections referred to in these Terms may not apply.

Business purchases may be subject to separate contractual rights and obligations.

If you are purchasing on behalf of a business, you confirm that you have authority to bind that business to the applicable agreement.

29. Governing Law

These Terms are governed by the applicable laws of England and Wales, subject to any mandatory consumer protections that apply to you.

If you are a consumer resident elsewhere in the United Kingdom, nothing in these Terms is intended to deprive you of mandatory legal protections available to you in your place of residence.

Any dispute will be dealt with by the courts having jurisdiction under applicable law.

30. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

31. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have permanently waived our right to enforce that provision.

32. Contact Information
